A nanny tripped over the family dog causing her to fall down a staircase and injure her back, head, and shoulder. Unable to work, the nanny sued the family for more than $20,000 for injuries and lost wages and allegedly the incident resulted in her having a miscarriage. Additionally, the nanny said the family “had direct knowledge that a claim had been submitted under their homeowner’s liability policy and denied because the incident did not fall under the conditions where homeowners insurance would come into play. Instead, the accident would only be covered if the family had a workers’ compensation policy in place – which they did not. Based on the gross annual pay received from the family for the past 3 years, the nanny was entitled to workers compensation benefits based on the state requirements.
